Terms & Conditions

These Terms and Conditions ("Terms") govern your purchase of products from RAToM Europe ("we", "us", "our") through our online shop at shop.ratom.eu. By placing an order, you agree to these Terms. Please read them carefully.

Scope

These Terms apply to all orders placed through shop.ratom.eu by consumers and businesses located in the European Union, United Kingdom, Norway, and Switzerland. For B2B wholesale orders placed via email or our inquiry form, separate terms may apply as agreed in writing.

Contract Formation

Product listings on our shop do not constitute a binding offer, but an invitation to place an order (invitatio ad offerendum). When you complete the checkout process and click "Place Order", you submit a binding offer to purchase the selected products.

A contract is formed when we send you an order confirmation email. We reserve the right to decline orders if products are unavailable or if we detect errors in pricing or product descriptions.

Pricing & Payment

All prices on shop.ratom.eu are listed in Euros (EUR) and include applicable VAT for EU customers. For customers in the UK, Norway, and Switzerland, additional import duties or local taxes may apply upon delivery and are the responsibility of the customer.

We accept payment methods as displayed at checkout (e.g. credit card, PayPal, or other methods provided by Shopify Payments). Payment is due at the time of order.

Shipping

We ship to the following regions:

Shipping costs and estimated delivery times are displayed at checkout before you complete your order. Risk of loss passes to you upon delivery. If a shipment is damaged in transit, please contact us within 14 days of receipt.

Right of Withdrawal

If you are a consumer in the EU, UK, or Norway, you have the right to withdraw from the contract within 14 days without giving any reason, in accordance with the EU Consumer Rights Directive (2011/83/EU) and equivalent national legislation.

The withdrawal period expires 14 days after the day on which you, or a third party indicated by you (other than the carrier), physically receives the goods.

To exercise your right of withdrawal, you must inform us of your decision by a clear statement sent to:

You may use the following template, though it is not required:

"I hereby give notice that I withdraw from my contract of sale for the following goods: [description/order number], ordered on [date], received on [date]. Name: [your name]. Address: [your address]. Date: [today]. Signature (only if sent by post)."

Returns & Refunds

If you exercise your right of withdrawal:

  1. Contact us at info@ratom.eu with your order number and reason for return.
  2. Return the goods without undue delay and in any event no later than 14 days from the day you communicate your withdrawal. You bear the direct cost of returning the goods.
  3. Goods must be returned in their original condition, unused and in original packaging where possible.
  4. We will reimburse all payments received from you (including the standard delivery costs) without undue delay and no later than 14 days from the day we receive the returned goods or evidence of return shipment, whichever is earlier.
  5. Refunds will be issued using the same payment method used for the original transaction.

We may reduce the refund to reflect any diminished value of the goods if the loss in value is due to unnecessary handling by you.

Swiss customers: While Switzerland does not mandate a statutory right of withdrawal for online purchases, we voluntarily extend the same 14-day withdrawal right to our Swiss customers as a matter of good practice.

Product Descriptions & Availability

We make every effort to ensure product descriptions and images on our shop are accurate. However, slight variations in colour, texture, or dimensions may occur due to the handcrafted nature of our products and differences in screen displays. Such variations do not constitute a defect.

Product availability is subject to stock. If a product becomes unavailable after you place an order, we will notify you promptly and offer a full refund.

Warranty & Defects

Statutory warranty rights apply. Under German law, consumers have a 2-year warranty period (Gewährleistung) for defective goods from the date of delivery. If you receive a defective product, please contact us at info@ratom.eu with photos and a description of the defect.

UK consumers benefit from statutory rights under the Consumer Rights Act 2015.

Limitation of Liability

We are liable without limitation for damages arising from injury to life, body, or health caused by our negligence, and for damages caused by intentional or grossly negligent conduct.

For slight negligence, we are only liable for breach of essential contractual obligations (cardinal obligations), and in such cases liability is limited to the foreseeable, typically occurring damage. This does not apply to claims under product liability law.

These limitations do not affect your statutory consumer rights, which remain unaffected.

Governing Law & Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

If you are a consumer residing in the EU, you also benefit from any mandatory provisions of the consumer protection law of your country of residence. Nothing in these Terms affects your rights as a consumer under applicable national law.

For consumers, the courts of your place of residence have jurisdiction. For merchants, the exclusive place of jurisdiction is Munich, Germany.

Dispute Resolution

The European Commission provides an online dispute resolution (ODR) platform: https://ec.europa.eu/consumers/odr/

We are not obliged and currently not willing to participate in dispute resolution proceedings before a consumer arbitration board. However, we are always open to resolving disputes directly. Please contact us at info@ratom.eu.

Changes to These Terms

We reserve the right to update these Terms from time to time. Changes will not apply retroactively to orders already placed. The version in effect at the time of your order applies. We encourage you to review these Terms periodically.
